1792 January 20 Samuel MOFFITT Robert DICKIE

 

NOTE: I have transcribed this using voice recognition, and even though I have trolled through it looking for errors, this does not mean that the following transcription is error free. It is the best that I can do at this time – given other calls on my time. I have yet to run down information on many of the names – but have left room in footnotes to add it later. This indenture made the Twentieth Day of January in the Year of our Lord God One Thousand Seven Hundred and Ninety two BETWEEN Samuel Moffitt[1] of Freeduff[2] in the County of Armagh, Gent of the 1st part; And Robert Dickie[3] of Clonaleenan[4] in the County of Louth Gent

of the other Part, WITNESSETH, that the said Samuel MOFFITT for and in consideration of the yearly Rents and Covenants herein after reserved, Hath demised, granted, set, and to Farm let; and by these Presents doth demise, grant, set, and to Farm let, unto the said Robert Dickie ALL that part of the lands of Carrickastuck in the actual Possession of the said Robert Dickie containing Eighteen Acres or thereabouts at the yearly rent of Twentyeight Pounds Sterling

 

TO HAVE AND TO HOLD the said demised Premises with the Rights, Members, and Appurtenances thereunto belonging, or in any wise appertaining, unto the said Robert Dickie, his Heirs, Exors, Admons and Assigns, from the first day of November last during the natural life of James Coulter[5] of Carrickastuck[6] Senior. He the said Robert Dickie his Heirs, Exors, Admons or Assigns

 

YIELDING AND PAYING thereof and thereout yearly, and every Year during the said Term  unto the said Samuel Moffitt his Heirs, Exors, Admons or Assigns, the sd yearly rent of Twnety Eight Pounds Sterling  to be paid by two equal Payments on every first day of May and every first day of November in every year during the said Term over and above all Taxes, Charges, and Impositions whatsoever; the first payment thereof to be made on the first day of May AND if the said reserved yearly rent, or any part thereof, shall happen to be behind or unpaid by the space of twenty-one Days next after the Days herein before mentioned for the payment thereof, then and so often as it shall so happen it shall and may be lawful to and for the said Samuel Moffitt his Heirs, Exors, Admons or Assigns on to the said demised Premises or any part thereof to enter and destrain, and the Distress and Distresses then and there found to lead drive  take away and dispose of according to Law; AND if no sufficient distress or distresses shall or may be found on the said demised Premises, to satisfy the said Rent and all Arrears thereof, then it shall and may be lawful to and for the said Samuel Moffitt his Heirs, Exors, Admons or Assigns into the said demised Premises or any Part thereof in the Name of the Whole, to reenter and the same to have again, repossess, and enjoy, as in his or their former Estate, any Thing in these Presents contained to the contrary in any wise notwithstanding. AND the said Robert Dickie, his Heirs, Exors, Admons doth for himself and his Heirs Exors Admons and Assigns, covenant promise, and agree to and with the said Samuel Moffitt his Heirs, Exors, Admons and Assigns by these Presents that he the said Robert Dickie, his Heirs, Exors, Admons and Assigns, shall and will from Time to Time, and at all Times hereafter during the Term hereby demised well and truly satisfied, content and paid to the said Samuel Moffitt his Heirs, Exors, Admons Assigns the said yearly Rent on the said days and times herein before mentioned for the payment thereof clear above all taxes as aforesaid. AND the said Robert Dickie, his Heirs, Exors, Admons and Assigns shall and will during this demise, preserve, uphold, support, maintain, and keep the said demise premises and improvements made and to be made thereunto in good and sufficient Order, Repair, and Condition, And at the end or Expiration  or other sooner Determination of this demise, shall and will so leave and yield up to the same unto the Samuel Moffitt his Heirs, Exors, Admons or Assigns. AND the said Samuel Moffitt doth herby for himself his Heirs and Assigns, covenant, promise and, and agreed to and with the said  Robert Dickie, his Heirs, Exors, Admons or Assigns paying the said reserved yearly Rent and performing the Covenants herein before mentioned, shall and may peaceably and quietly have, hold, and enjoy the said Premises with the Appurtenances, during the Term hereby demise, without any Let, Hindrance, Interruption, or Disturbance of the said Samuel Moffitt his Heirs, Exors, Admons or Assigns or any other Person or Persons claiming or deriving from or under him of them, or any of them Be it remembered before Perfection that the said Robert Dickie his Heirs Exors Admons and Assign shall and will up[hold and fulfill the Clauses and agreements[7] in the Lease which Charles Coulter[8] of Annaghavacky[9] hath made to the said Samuel Moffit of the said demised premises.

[1] Samuel MOFFITT aka MAFFETT aka MOFFETT

[2] Freeduff,Parish of Creggan,  Co. Armagh

[3] Robert DICKIE (abt 1740-bef 1825), son of Samuel James DICKIE and Mary BAILEY. Husband of Mary REID. They had nine known children.

[4] Clonaleenan, Parish of Creggan, Co. Louth. 311 acres. It is bounded by Barronstown to the east, Carrickastuck and Annaghvacky to the north, Shanmullagh to the west and Derryfalone to the south (amongst others).

[5] James COULTER senior In the July 6, 1795 deed, he is referred to as James COULTER the elder. He was the father of Charles and Henry COULTER  He was born bef 1734. SOURCE: he is mentioned in1735 Aug 27 DEED: 80 473 56629 mentioned as son of Charles COULTER, and in 1734 Mar 11 DEED: 82 179 57452

[7] There must be agreements made between Charles COULTER and Samuel MOFFITT that I do not yet have.

[8] Charles COULTER. He is the son of James COULTER and brother of Henry COULTER. Other deeds connect him to Annaghavacky, which is also called Roachdale. There are earlier deeds that also shed light on the family connections (1734)

[11] Patrick CORR NOTE: He is likely connected to the CORR family of Urcher, but I do not know anything about him.
