NOTE: This line of the OLIVERs is a side line of the OLIVER line that I am most focussed on - but since there is some alleged intermarriage between the two lines and since this Susannah OLIVER was born in Ardagh and since the OLIVERs of Ulster also entered into other leases with Rev. Dr. Hugh HAMILTON, it is worth noting this particular deed. It may also help lead us to the particulars of the later OLIVER family debts concerning Laragh mills which were owed to the HAMILTON family. The footnoting is not extensive, but should be enough to get a good idea.

To the Register Appointed by Act of Parliament for Registering Deeds Conveyances and so forth. A Memorial of an indented Deed bearing date the seventeenth day of August eighteen hundred and one made Between the Rev. Hans HAMILTON [1] Clerk second son of the Right Reverend Father in God Hugh HAMILTON [2] Bishop of Ossory of the first part, Susanna OLIVER [3] spinster daughter of the Right Honourable Silver OLIVER [4] deceased of the second part, the said Hugh Bishop of Ossory the third part, and Charles Silver OLIVER [5] of Castle OLIVER in the County of Limerick as Esq. and Alexander HAMILTON [6] Esq. Barrister at Law and eldest son of the said Bishop of Ossory of the fourth part and Isabella WALLER [7] or otherwise OLIVER of the fifth part and reciting that the said Susanna OLIVER under & by virtue of the Marriage Settlement of her Father the said Silver OLIVER deceased dated seventh July one thousand seven hundred and fifty nine and under & by virtue of the last Will of her said father was entitled to three thousand one hundred and twelve pounds ten shillings and also under said will entitled to the further sum of one thousand eight hundred and eighty seven pounds ten shillings and reciting that the said Hugh Bishop of Ossory by his name of the Rev. Hugh HAMILTON Dean of Armagh did in or as of Trinity term one thousand eight hundred and one obtain a Judgment in the Court of King’s bench in Ireland against Charles HAMILTON [8] of Hamwood in the County of Meath Esq. for the sum of four thousand pounds Sterl Debt besides costs and that the said Hans HAMILTON did on the day of the Execution of this Deed of which this is a meml execute unto the said Chs Silver OLIVER and Alexr HAMILTON his Bond in the Penal sum of two thousand pounds concluded for the payment of one thousand pounds on the day therein mentioned and trusting that a marriage was then intended shortly to be had and solemnized between the said Hans HAMILTON and Susanna OLIVER and that the sd sevl securities should be vested in the said Chs Silver OLIVER and Alexr HAMILTON as a Provision for the said Susanna OLIVER & the issue of said marriage and reciting that the said Hans HAMILTON had insured his life for four thousand pounds which had been agreed should be vested in the said Chs Silver OLIVER and Alexr HAMILTON as an addl Provision for the said Susanna and the issue of said marriage. The said Deed witnessed that the said Susanna OLIVER in consideration of said intended marriage & for the further consideration in the said Deed mentd, did grant Bargain Sell Assign Transfer & set over unto the said Charles Silver OLIVER and Alexander HAMILTON the said two sums of three thousand one hundred and twelve pounds ten shillings and one thousand eight hundred pounds ten shillings and all the securities for the same and all her rights Title Interest thereto To hold the said Charles Silver OLIVER and Alexr HAMILTON their Exors Admors and Assigns upon the Trusts in the said Deed mentioned, And the said Hugh Bishop of Ossory did also assign the said Judgment to the said Charles Silver OLIVER and Alexander HAMILTON their Exors Admors and Assigns upon the Trusts therein mentioned. And it was by the said Deed Declared that the several securities thereby vested in the said Charles Silver OLIVER & Alexr HAMILTON were so vested in them upon the several trusts therein mentioned and among others upon Trust that in case the said Hans HAMILTON should live for the Term of four years to be computed from the solemnization of said marriage and should leave said Susanna OLIVER him surviving and also Issue of said marriage then that the said Charles Silver OLIVER & Alexander HAMILTON should pay unto the said Susanna OLIVER or her assigns a yearly during her Life out of the Annual interest and proceeds of the said several securities amounting in the whole to twelve thousand pounds (without prejudice however to the payment of the Interest of one thousand pounds at six per cent to the said Hugh Bishop of Ossory and Isabella HAMILTON otherwise WOOD his wife as therein mentioned one a Annuity and yearly sum of 400 pounds by two equal payments to the first Gale thereof to be paid to said Susanna OLIVER or her assigns the day after the Decease of the said Hans HAMILTON and in case she should live for the term of four years to be computed from the solemnization of said marriage and die before the end of eight years to be computed from the period aforesaid and issue of said marriage then in Trust to pay the said Susanna OLIVER or her Assigns out of the funds aforesaid a yearly sum of four hundred and forty pounds payable by two equal payments the first Gale thereof to be paid the day after Decease of the said Hans HAMILTON in case he should live for eight years to be computed from the Solemnization of Marriage and Issue of said Marriage then in Trust to pay unto the said Susanna OLIVER or her Assigns during her life the yearly sum of four hundred and eighty pounds payable half yearly the first Gale thereof to be paid the day after the Decease of the said Hans HAMILTON the same to be in lieu Satisfaction and bar of any Dower or thirds at Common Law,  And the said Hans HAMILTON did by sd Deed Assign to the said Charles Silver OLIVER and Alex HAMILTON the said Policies of Insurance and the principal sums of two thousand pounds and two thousand pounds thereby secured upon the Trust’s aforesd and the other Trusts in said Deed mentioned.  And the said Hans HAMILTON did thereby Covenant that he would duly every year during his life pay the Necessary Premiums of the said two Sums according to the Tenor and effect of the said Policies of Insurance and which preserve and keep the said Policies of Insurance in continual force & effect so that the full sum of four thousand pounds shd become payable to his Exors Admors or Assigns upon the Death of him the said Hans HAMILTON - which said Deed as to the Execution thereof by the sd Reverend Hugh Bishop of Ossory is witnessed by John WALSH [9] and John KELLY [10] both of the city of Kilkenny gentlemen which said Deed as to the Execution thereof by the said Hans HAMILTON, Susanna OLIVER & Isabella WALLER is witnessed by Henry WADE [11] of the city of Dublin Gentleman and Attorney and John WALLER [12] of Castletown in the County of Limerick Esq. and the execution of  this Memorial is witnessed by the said Henry [13] and John WALLER.

The above named Henry Wade make this oath and says that he saw the Deed of which the above writing is in part memorial & duly executed by the said Hans HAMILTON Susanna OLIVER and Isabella WALLER and that he saw the above Memorial duly executed by the said Hans HAMILTON and that the same Henry WADE subscribed as witness Deeds and memorial is this deep on this name and handwriting and says that he delivered this Deed a memorial to John GRIFFIN [14] of the Deputy Registrar the 22nd day of August 1801 at or half after one old clock in the afternoon

[1] Rev. Hans HAMILTON second son of Rev. Dr. Hugh HAMILTON, Bishop of Ossory.

[2] Hugh HAMILTON, Bishop of Ossory. B. 26 March 1729 & died 01 Dec 1805. Dean of Armagh; TCD MA, 1750; DD, 1762; FTCD, 1751-64; professor of natural philosophy, 1759; dean of Armagh, 1768-96; FRS; Bishop of Clonfert, 1796-99; Bishop of Ossory, 1799; collected works (1809). He had an interest in the observatory. He married Isabella WOOD August 6, 1772 (daughter of Hans Widman WOOD & Frances KING). [3] Susanna OLIVER, b. 1764 at Ardagh, daughter of Silver OLIVER and Isabella Sarah NEWMAN. She was the wife of Hans HAMILTON and mother of Sarah HAMILTON (who married George WOODS). NOTE: If she married after August 1801, she would have been at least 37 years old at the time of her marriage. They had only one known child.

[4] Right Honourable Silver OLIVER b. abt 1729 NOTE: This is not the same Silver OLIVER who was the Bishop of Loughgall – although they are related.

[5] Charles Silver OLIVER of Castle OLIVER in the County of Limerick as Esq.  B abt 1763 & d. Oct 10, 1817, son of  Silver OLIVER and Isabella Sarah NEWMAN (brother of Isabella Sarah OLIVER & Susanna OLIVER)

[6] Alexander HAMILTON Esq. Barrister at Law and eldest son of Hugh HAMILTON, Bishop of Ossory and Isabella WOOD. He was born 1774 in Newtown, Co. Armagh and died 1840. He married Juliana TISDALL. He was the older brother of Hans HAMILTON.

[7] Isabella Sarah WALLER née OLIVER. Sister of Susannah OLIVER and daughter of Silver OLIVER & Isabella NEWMAN. She married John WALLER.

[8] Charles HAMILTON Esq. of Hamwood, Parish of Dunboyne, County of Meath.
