NOTE: I have transcribed this using voice recognition, and even though I have trolled through it looking for errors, this does not mean that the following transcription is error free. It is however the best that I can do at this time – given other calls on my time. I have yet to run down information on many of the names – but have left room in footnotes to add them later.

 

THIS INDENTURE made the eighth day of April in the year of our Lord God one thousand seven hundred and eighty nine BETWEEN Charles Coulter[1] of Roachdale[2] senior in the County of Louth farmer of the one part and Mary McCormick[3] daughter to Hugh McCormick[4] and Arthur McCormick[5] both of Carrickastuck[6] of the other part, WITNESSETH, that the said Charles Coulter senior: -- for and in Consideration of the yearly rents and covenants hereinafter reserved hath demised, granted, set and to farm let: and by these presents, demised granted set and to farm let unto the said Mary McCormick and Arthur McCormick -- all that part of the house and garden now in the said Arthur McCormick's actual possession then being 20 perches or thereabouts by the same or more same more or less lying on the North side of the road in the townland of Carrickastuck leading from Dundalk Castleblaney, for and during the natural life for lives of Ralph Coulter[7] son to Henry Coulter[8] of Carrickastuck; and William Coulter[9] and Charles Coulter[10] sons of Charles Coulter of Roachdale senior, or the longest liver of both of them or 41 years whatsoever shall continue longest.

TO HAVE AND TO HOLD the said demised premises, with the rights, members, and appurtenances thereunto belonging, or any wise appertaining, unto the said Mary McCormick and Arthur McCormick their heirs Exors Admons and assigns to commence at the decease of John Coulter[11] senior of Mount Hill[12] in the County of Armagh, and James Coulter[13] of Carrickastuck in the County of Louth.

 

YIELDING AND PAYING therefore and thereout yearly and every year during the said term onto the said Charles Coulter his heirs exors admons or assigns the yearly rent of 12 shillings and sixpence sterling to be paid by two equal payments half yearly in every year during the said term over and above all taxes charges and impositions whatsoever and if the said reserved yearly rent, or any part thereof, shall happen to be behind or unpaid by the space of 21 days next after the days here in before mentioned for the payment thereof then in so often as it shall so happen it shall and may be lawful to and for the said Charles Coulter his heirs exors admons or assigns into the said demise premises or any part thereof to enter and destrain, and the distress and distresses then and there found to Lead, and take away and dispose of according to law; and if no sufficient distress or distresses shall or may be found on the said demised premises, to satisfy the said rent and all arrears thereof, then it shall and may be lawful to and for the said Charles Coulter his heirs exors admons or assigns into the said demised premises or any part thereof and the whole to reenter and the same to have again, repossess, and enjoy, as in his or their former estate, anything in these presents contained to the contrary in any wise notwithstanding. And the said Mary McCormick and Arthur McCormick for themselves and their heirs and admons and assigns covenant promise and agreed to and with the said Charles Coulter his heirs and exors and admons and assigns by these presents that they the said Mary McCormick and Arthur McCormick their heirs and assigns shall and will from time to time and at all times hereafter during the term herein demised, well and truly satisfy content and paid to the said Charles Coulter his heirs and exors or admons or assigns the said yearly rent on the said days and times herein before mentioned for the payment thereof clear above all taxes as aforesaid. And that the said Mary McCormick and Arthur McCormick their heirs or assigns shall and will during this demise prove, preserve, uphold, support, maintain, and keep the said demised premises, and all improvements made and to be made thereon in good and sufficient order, repair, and condition: and at the end or expiration or other sooner determination of this demise, shall and will leave and yield up the same unto the said Charles Coulter his heirs and exors or admons or assigns. In the said Charles Coulter hereby for himself his heirs exhors and assigns, covenant promise and agreed to and with the said Mary McCormick and Arthur McCormick their heirs and assigns that the said Mary McCourt and Arthur McCormick their heirs and assigns paying the said reserved yearly rent, and performing the covenants herein before mentioned, shall and may peaceably and quietly have, hold, and enjoy, the said premises, with the appurtenances, during the term herein demised, without any let, hindrance, interruption or disturbance of the said Charles Coulter senior exors admons or assigns or any other person or persons claiming or deriving from or under him them or any of them. In witness thereof the witnesses to these presents have hereunto or set their hands and seals the day and year above first written.

[1] Charles COULTER He is the son of James COULTER and brother of Henry COULTER. Other deeds connect him to Annavacky, which is also called Roachdale. There are earlier deeds that also shed light on the family connections (1734)

[8] Henry COULTER  He was the brother of Charles COULTER sr. This relationship was mentioned in a later deed- July 6, 1795.

[10] Charles COULTER, son of Charles COULTER sr.

[11] John COULTER sr.  I am guessing that he might be the father or else grandfather of Samuel COULTER of Mount Hill.

[12] Mount Hill aka Mounthill NOTE: There was a Samuel COULTER who died at Mount Hill, Co. Louth in 1841 whose son Samuel was born abt 1810 (he was the one who was murdered at Shortstone in 1851). [13] James COULTER. In the July 6, 1795 deed, he is referred to as James COULTER the elder. He was the father of Charles and Henry COULTER  He was born bef 1734. SOURCE: he is mentioned in1735 Aug 27 DEED: 80 473 56629 mentioned as son of Charles COULTER, and in 1734 Mar 11 DEED: 82 179 57452

[15] Samuel MOFFETT  NOTE: An Anne MAFFETT married Thomas COULTER (1658-1754) – so there was at least a familial connection. I believe that it was his sister Mary who married Samuel DONALDSON
