To the Register appointed by Act of Parliament for Registering Deeds, Conveyances and so forth. A memorial of indented deed of marriage settlement bearing the date the twenty ninth of February one thousand seven hundred and ninety two and duly executed between James Breakey, son of Isaiah Breakey of Milford in the county of Monaghan linen draper, of the one part, Mary Fleming eldest daughter of Ann Fleming of Bawn in the County of Meath widow, of the second part, the said Isaiah Breakey of the third part, the said Ann Fleming of the fourth part, Patrick Boyd of Bawn in the County of Meath, Gent., and William Breakey of Drumskelt in the county of Monaghan linen draper of the fifth part. Reciting that a marriage was to be had and solemnized between the said James Breakey and the said Mary Fleming and reciting that the said Isaiah Breakey was then seized and pofsefsed of the town and lands of Derry with part of the town and lands of Millmore in the county of Monaghan containing in the whole eighty four acres three roods Irish measure and the one half of the turf bog of Millmore by virtue of a lease to him thereof made by John Ker Esq. dated the twenty fourth of May one thousand seven hundred and eighty one during the term of twenty one years renewable forever and reciting that the said Isaiah Breakey did in order to provide for the said James Breakey did grant bargain and sell to the said James Breakey his Heirs, Ex’cors Adm’ors  and Afsigns  thirty acres of the said lands of Derry and Millmore with one third part of the bog of Millmore, he the said James Breakey his Heirs, Ex’cors Adm’ors paying a proportion able [sic]  part of the chief rent that the said Isaiah Breakey was bound to pay and reciting that the said Ann Fleming was then pofsefsed of the town and lands of Bawn, C [illegible],  part of Mullaghavally, [appears as Clocksteukagh]  and Corranery situate in the counties of Meath and Cavan by virtue of the last will of David Boyd then late of the county of the city of Dublin to hold to the said Ann Fleming during her natural life, and after her death to go to the  nephews and nieces of the said David Boyd children of William Fleming share and share alike and The said Ann Fleming in order to provide for the said Mary Fleming in consideration of said marriage did grant and agree with the said James Breakey his Heirs Ex’cors Adm’ors and afsigns should take and receive out of the profits of all the said lands of Bawn, C [illegible], part of Mullaghavally, [appears as Clocksteukagh] and Corranery the [illegible] yearly sum of twenty five pounds str. And reciting that the said James Breakey in consideration of said marriage and other the considerations therein mentioned did grant bargain release and confirm unto said Patrick Boyd and William Breakey their heirs Ex’cors Adm’ors and afsigns all his estate, right, title and interest in the said thirty acres of the lands of Derry, Millmore and turf bog of Millmore to hold to the said Patrick Boyd and William Breakey their Heirs, Ex’cors Adm’ors and afsigns in trust to the use of the said James Breakey during his natural life and after his death in trust for the said Mary Fleming and her ifsue but to permit the said James Breakey and his afsigns to receive the ifsues and profits thereof during his life  and after his death in case he should be without ifsue, then to the use of the said Mary Fleming in case she should survive him the said James Breakey, to receive thereout the yearly sum of thirty pounds st. payable half yearly after the death of the said James Breakey and in which said died. There are other clauses and covenants, and is witnefsed by James Leeky of the town of Monaghan, att’y, William Breakey of Lea, Gent both in the county of Monaghan and the Rev’d William Moore of Kingscourt in the county of Cavan and this memorial is also witnefsed by the said James Leeky and John Gibson of Drumlun in the county of Cavan, Gent. and by Mic’l  ---ningham. Signed and sealed in presence of John Gibson James Leekey Mic’l   ---ningham   The above named James Leekey aged thirty years and upwards maketh oath and saith he is a subscribing Witnefs to the deed of settlement whereof the above writing is a memorial and saw the same duly [illegible] by the said Isaiah Breakey and is also a subscribing Witnefs to this memorial  and saw the same duly signed and sealed by the said James Breakey and saith the name James Leekey subscribed as a Witnefs is the depont’s  proper name and writing.   Sworn before me at Kings Court in the county of Cavan this 24th day of July 1810 by virtue of a commifsion to me directed for taking affid’ts and [illegible] from the deponent. This Deed is mentioned in HENRY WILLIAM OLIVER 1807-1888: His Descendants by Henry Oliver Rea. James OLIVER Sr. was born in 1750 and had three sons: Stephen, James & William (all mentioned in the deed). On 31 December 1790, James OLIVER Sr. had leased this land from William IRVINE and apparently transferred it to his son William OLIVER (b. abt 1780) who was farming at "Six Mile Cross" - about six miles from Tattykeel, Co. Tyrone. At the time, both Stephen OLIVER and his father James OLIVER were resident at Corchoney.

Deed of conveyance by James OLIVER of Corconny, Parish of Kildeep?, Co. Tyrone  of the one part and William OLIVER of Lisnae Corss, Co [illegible] and of the said James OLIVER ... that William Junior? Esq. Due by fiduciary? Legacy date the 31^st day of Dec 1790 did demure and sell unto the said James OLIVER  all the holding occupied by the said James OLIVER in Tullykeel in the Parish of Killduffs in the Parish of Tyrone containing 13 acres 3.10 perches with the same more or less [?] two days labour  of a man yearly.  To hold to the said James Olliver  his heirs  {/, ?, } from the first day of November then last for the acres of Stephen OLIVER, James OLIVER,  and Wm OLIVER sons of the aforesaid James Olliver party thereto at the yearly rent  of sixteen shillings per acre and one shilling per pound [?] fees. He the Said James OLIVER in conferring the sum of [pounds]60  to him paid by the said William OLIVER  did thereby sell  {?] transfer and make over to the said William OLIVER his heirs and assign all  [?] property  and Claim whatever to the said part of Tullykist[?]  containing 13 acres 3.10 perches [?] with the Dwelling House & offices and Houses & appurtenances then in the actual possession of Stephen OLIVER to hold to the said Wm OLIVER ... A Memorial of an indented deed of conveyance between William JACKSON of Constable Hill in the County of Carlow Gent of the first part; John JACKSON of the same place, Gent, son of the said William and Jane BROWNE of Maplestown in County Carlow, spinster the intended wife of the said John JACKSON of the second part and James BROWNE of Maplestown of County Carlow, Gent and father of said Jane of the third part. Reciting that a marriage is intended between the said John JACKSON and Jane BROWNE that said William JACKSON in consideration of love and affection to his son, and of £200, the marriage portion of said Jane to said John JACKSON in hand paid by said Jane BROWNE, the receipt whereof is thereby acknowledged and to secure a provision for the said Jane and the issue of said marriage in case she or they survive the said John JACKSON said William JACKSON agreed to assign unto the said John JACKSON his the said William interest in the lands and premises therein, and hereafter mentioned and his right to his stock of cattle goods chattles and effects of what nature or kind soever and reciting an indented deed bearing date the 8^th March 1804 between Charles HEMMELL then of Hackettstown in the said County of Carlow farmer and the said William JACKSON said HEMMELL in consideration of £193.0.8 did bargain and sale under the said William JACKSON said Charles HEMMELL his title and interest all that and those that part of the lands of Knockboy situate in the County of Carlow as formerly in the possession of Patrick REDMOND containing 62 acres or thereabouts. To hold unto the said William JACKSON his heirs and assigns two years … during the lives and life of him and said Charles HEMMELL Thomas NORTON of Knocknaboly in the County of Wicklow and George DUNBAR of Dalkey in the County of Dublin, Shoemaker and the surety of them subject to the yearly rent of £6% with 12d in the pound Recrs fees and two couple of full turkeys every Christmas or so when thereof to the honourable John STRATFORD therein named payable half yearly as therein mentioned and also receipt of certain other in dentures of conveyance bearing date 14 April 1804, by which James WALSH and Charles WALSH therein named did grant and sell unto William JACKSON all that part of the lands of Constable Hill, Co Carlow containing 21a 3r 36p to hold unto the said William JACKSON during the natural life of Ebeneezer WATERS, son of John WATERS therein and 31 years from 25 March 1797, which ever lasts longest at the yearly rent of £28 payable half yearly is therein mentioned and also reciting an indentured deed of lease bearing date 12 December 1808 between Marcella BYRNE, widow and said William JACKSON whereby said Marcella BYRNE did demise and grant unto the said William JACKSON, his executors, administrators and assigns for the term of 18 years at the yearly rent of £1.19 shillings 40 acres [?] in proportion for parts of an acre payable half yearly as therein mentioned and said deed of settlement of which this is a Memorial witnessed that William JACKSON for the consideration aforesaid did grant bargain and sell unto the said John JACKSON and Jane BROWNE as trustee. Reciting in their actual possession being in virtue of a deed of bargain of sale for a year as therein mentioned and to their heirs and assigns all that and those the aforesaid lands of Knockboy and Constable Hill. To hold to them their heirs and assigns for and during the lives and years granted thereof and also all that and those the aforesaid lands of Coolmanna and to hold same unto said John JACKSON and James BROWNE their executors administrators and assigns for and during the residue of 18 years yet to come and [?] of same and all the estate right title and interest of said William JACKSON of in and to the same subject to the rent fees and duties to the performance of the covenants in the original lease and the testimony part and to the annuity and sum of money [?] and after mentioned and to the trusts there in and after mentioned that is to say in trust to the use of John JACKSON for life and after his death in case said Jane BROWNE survives that it shall be lawful for her to take to her own use thereof one yearly rent charge of £25 there be no issue of said marriage but in case there are such issue then only £20 yearly with a covenant on the part of John JACKSON. That said yearly sums shall not only a charge and lean on the premises aforesaid, but also on the property he may become entitled to or died possessing of and [?] though [?] trust after the death of John JACKSON said lands and premises shall go to the use and benefit of the issue of said marriage in such share and proportion, if more than one child as said John JACKSON shall by deeds [?] will appoint to and said deed contains a lease covenant that said William JACKSON and his wife Sarah are to remain in the dwellinghouse of Constable Hill and be provided with all necessities but in case they wish to live apart then to have one annuity of said yearly for their joint lives charges chargeable on all the said property and also the said William JACKSON may encumber same with £100 to be disposed of by deed or will as he may think proper with other usual covenants which said deed and this Memorial are witnessed by John JONES of Woodri[?] [aka Woodside, Hacketstown, Barony Rathvilly?] in the said County of Carlow and John LAWLER of Tullow County Carlow gent and attorney at law. Indented deed of release made between Hugh JACKSON the younger of Cremore Green in the County of Monaghan Esquire and John JACKSON of Rock mon in the said County, Esquire, brother of the said Hugh JACKSON of the first part; Josias C GAMBLE of the bank in the County of Dublin merchant of the second part; Sir William Alexander, Bart. Robert Alexander Bart and William James Alexander, Esquire. of the city of Dublin bankers of the third part; John Moore, of drum Bannagh, Robert McCan and Meredith Fox both of Newry all in the County of Armagh Esquire bankers of the fourth part; one James BELL of Comber and Street North and Francis Hamilton of Dominick Street, both in the city of Dublin Esquires of the fifth part reciting that by deed of release bearing date the seventh day of October 1734, by Henry JACKSON [?] in the County of Meath, gent demised under Hugh JACKSON of Aughnafarnana in said County gent all that part of the 16 poles of Ballynatlcknuff then in his possession containing by estimation 40 acres more or less situate in the Barony of Kells in the County of Meath excepting as therein is excepted to hold unto the said Hugh JACKSON his heirs and assigns for three lives therein mentioned and the survivor of them renewable for ever at the yearly rent of 7 sterling and £3.10 shillings as a fine for renewal on the fall of each life further recites that by another deed of release bearing date the 13^th day of June 1781. The Lord Baron Derby demised with. Richard main of killer one in the County of Down. Hand all that part of the land of Cardwillan  & Edenforan then in possession of William MAYNE of Trimemount County Monaghan Esquire containing by estimation hundred and 2 acres two roods exclusive of bog be the same more or less situate in the Barony of Amamullin [should this be parish Aghnamullen ] County of Monaghan with the appurtenances excepting all those in to hold unto the said Richard MAYNE and his heirs for the lives of the said William MAYNE and of John MAYNE and Charles MAYNE his brothers at the yearly rent of £48.19 shillings, eight pence with a [?] for perpetual renewal of 15 acres of said premises on the terms of erecting a bleaching mill there on and that by an endorsement on the back of said last mentioned deed bearing date the 15^th day of March 1785 after confronting as there in mentioned the said Baron Derby [?] that upon their being two Mills bleaching works races and Greens for a bleaching linen cloth erected on said lands and fit for use within six years from the date there of, he would renew said demise as to 30 acres there of and that same should be renewable for further reciting that by deed of release bearing date the third day of January 1786 William DALY of Ballybay in the County of Monaghan demised unto Alexander JACKSON father of the said Hugh JACKSON and John JACKSON all that part of the lands of Bowelk in the possession of James Mccollan containing 5 acres three roods or thereabouts as the same would survey together with all breach Mills and waterfalls in the townlands of Bowelke & Drumfaldragh with the appurtenances said lands lying and being in the parish of Aghamullen County of Monaghan. To hold the said Alexander JACKSON his heirs and assigns from the first day of November then last for ever at the yearly rent of £200…. More legal detail … House, offices garden and land near island bridge in the County of the city of Dublin then late in the… Bounded on the North by the grand road leading from Dublin to Chapelizod on the South by the River Liffey. On the East by the [?] on the West island bridge to hold unto the said Josias see gamble his heirs assigns for the lives of George Worthington second son of the said [?] William Worthington Samuel CUMING [?] elder son of Joseph CUMING now of Creevy in the County of Monaghan and James GAMBLE son of George GAMBLE of grain in the County of Fermanagh renewable for ever as therein mentioned at the yearly rent of £100 payable half yearly….
